In Simple Terms: FindMySize is a free notification service. We'll do our best to notify you when shoes you want become available, but we can't guarantee we'll catch every restock. You're responsible for checking prices and making your own purchase decisions. We may earn affiliate commissions, but this doesn't cost you anything extra.

1. Acceptance of Terms

Welcome to FindMySize! By accessing or using our website and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, please do not use our service.

These Terms constitute a legally binding agreement between you and FindMySize. We reserve the right to update these Terms at any time, and your continued use of the service after changes constitutes acceptance of the new Terms.

FindMySize is a free notification service that monitors South African online retailers for shoe availability and alerts users when requested shoes become available or go on sale.

2.1 What We Do

Collect your shoe preferences (brand, model, size, color, width)
Monitor South African retailers for matching products
Send email notifications when matches are found
Provide links to retailer websites where shoes are available

2.2 What We Don't Do

We do NOT sell shoes directly
We do NOT process payments or handle transactions
We do NOT guarantee product availability (retailers' stock changes constantly)
We do NOT guarantee pricing accuracy
We are NOT responsible for retailer policies, shipping, returns, or customer service

3. User Eligibility

You must be at least 18 years old to use this service. By using FindMySize, you represent that:

You are 18 years of age or older
You have the legal capacity to enter into these Terms
You will provide accurate and truthful information
You will use the service for lawful purposes only

4. User Responsibilities

4.1 Accurate Information

You agree to provide accurate, current, and complete information when submitting alert requests, particularly your email address.

4.2 Email Access

You are responsible for maintaining access to the email address you provide and for checking it regularly for notifications.

4.3 Prohibited Uses

You agree NOT to:

Submit fake or spam requests
Use automated bots or scripts to submit bulk requests
Attempt to overwhelm or abuse our systems
Collect or harvest data from our service
Use the service for any illegal purpose
Impersonate another person or provide false information
Interfere with the proper functioning of the service

5. How the Service Works

5.1 Alert Requests

When you submit an alert request, we store your preferences and monitor for matches. There is no guarantee that:

We will find your requested shoe
The shoe will be available when we notify you
The price will be within your budget
The retailer will have your size in stock

5.2 Notifications

Notifications are sent on a "best effort" basis. We cannot guarantee:

Immediate notifications (there may be delays)
That we'll catch every restock or sale
That products will still be available when you receive the notification
Email delivery (emails may go to spam, or email services may fail)

5.3 Your Responsibility

You are solely responsible for:

Checking the retailer's website for current pricing and availability
Verifying product details before purchasing
Understanding the retailer's return and shipping policies
Making your own purchase decisions

6. Affiliate Relationships & Commissions

6.1 Affiliate Disclosure

FindMySize participates in affiliate marketing programs with South African retailers. When we send you a notification with a product link, it may be an affiliate link. If you purchase through that link, we may earn a commission at no extra cost to you.

6.2 No Influence on Recommendations

Our affiliate relationships do NOT influence which shoes we notify you about. We notify you based solely on:

Your requested preferences (brand, size, color, etc.)
Actual product availability at retailers

6.3 Pricing

Affiliate commissions do not increase the price you pay. The retailer pays us a small percentage of the sale, and you pay the same price as any other customer.

6.4 Our Commitment

We maintain editorial independence. We will never:

Send you notifications for products you didn't request
Prioritize one retailer over another based on commission rates
Recommend products you haven't asked for just to earn commissions

7. No Warranties

IMPORTANT: FindMySize is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

We specifically disclaim all warranties, including but not limited to:

Accuracy: We don't guarantee that pricing, availability, or product information is accurate
Completeness: We may not catch every restock or sale
Timeliness: Notifications may be delayed or not delivered
Availability: The service may be interrupted, suspended, or terminated at any time
Results: We don't guarantee you'll find or purchase the shoes you want

8. Limitation of Liability

8.1 No Liability for Third Parties

FindMySize is NOT responsible for:

Actions or policies of third-party retailers
Product quality, authenticity, or condition
Shipping delays, damages, or losses
Return or refund issues with retailers
Pricing errors on retailer websites
Stock availability at retailers

8.2 Maximum Liability

To the maximum extent permitted by South African law, FindMySize's total liability for any claims arising from your use of the service shall not exceed R100 (One Hundred Rand).

8.3 Excluded Damages

We are NOT liable for any indirect, incidental, special, consequential, or punitive damages, including:

Lost profits or opportunities
Missed sales or restocks
Data loss
Emotional distress
Any other damages arising from use of the service

9. Indemnification

You agree to indemnify, defend, and hold harmless FindMySize and its operators from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of the service
Your violation of these Terms
Your violation of any third-party rights
Any purchases you make from retailers

10. Data Protection & Privacy

Your use of FindMySize is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in compliance with POPIA (Protection of Personal Information Act).

By using this service, you consent to our collection and use of your information as described in the Privacy Policy.

11. Intellectual Property

11.1 Our Content

All content on FindMySize, including text, graphics, logos, and software, is the property of FindMySize and is protected by South African and international copyright laws.

11.2 Trademarks

Brand names and logos mentioned in our service (Nike, Adidas, etc.) are trademarks of their respective owners. We do not claim ownership of these marks.

11.3 User License

We grant you a limited, non-exclusive, non-transferable license to access and use the service for personal, non-commercial purposes only.

12. Third-Party Links

Our notifications contain links to third-party retailer websites. We are not responsible for:

The content of third-party websites
The privacy practices of retailers
The accuracy of information on retailer sites
Transactions conducted with retailers

Your interactions with retailers are solely between you and them. We encourage you to review their terms of service and privacy policies.

13. Service Modifications & Termination

13.1 Right to Modify

We reserve the right to:

Modify or discontinue the service at any time without notice
Change features, functionality, or availability
Refuse service to anyone for any reason
Delete alert requests at our discretion

13.2 Your Right to Terminate

You can stop using the service at any time by unsubscribing from notifications or contacting us to delete your data.

13.3 No Refunds

Since FindMySize is a free service, there are no refunds to issue.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of the service shall be subject to the exclusive jurisdiction of the South African courts.

15. Dispute Resolution

15.1 Informal Resolution

If you have a complaint or dispute, please contact us first at findmysizealerts@gmail.com. We'll do our best to resolve it amicably.

15.2 Arbitration

If informal resolution fails, disputes may be resolved through arbitration in accordance with South African law.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FindMySize regarding the use of our service.

18. No Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
